Pursuant to the Bill (Reg. No. 3307), "an appeal concerning establishment or liquidation of courts of general jurisdiction, as well as the limiting number of personnel of the said courts are to be approved by the Cabinet of Ministers of Ukraine".
The Committee members expressed a number of remarks concerning the Bill. Thus, authorities of the Cabinet of Ministers of Ukraine appertaining to the approval of the limiting number of personnel of courts of general jurisdiction can create "prerequisites for pressure on the said courts exerted by the supreme executive bodies".
Moreover, according to Article 20 of the effective Law, "courts of general jurisdiction are established and liquidated by the President of Ukraine on the grounds of an appeal of the Minister of Justice of Ukraine that should be coordinated with the Head of the Supreme Court of Ukraine or the Head of a corresponding high specialized court". Thus, the Law envisages participation of executive bodies as represented by the Minister of Justice of Ukraine in the settlement of issues related to the establishment and liquidation of courts of general jurisdiction.
